Terms of Service

The terms for the app, website, account and agent access.

Provider and scope

These terms cover the Bookheap app, this website, the optional account with sync, and access through AI agents. The provider is Andrei Svirida; the address and contact details are in the legal notice. You use Bookheap as a consumer; these terms do not restrict your statutory rights.

The service and its availability

The app is free and contains no purchases. We aim to keep the service reachable but owe no particular level of availability. Maintenance, faults and the change or discontinuation of individual features may occur.

Bookheap makes no health-related statements, gives no diagnosis, offers no medical or other professional advice and is no substitute for it. What the app suggests is a prompt you are free to ignore.

Account and your obligations

An account is optional. Keeping your credentials safe, and to yourself, is your responsibility.

You agree not to misuse Bookheap: no unlawful content, no attempts to reach anyone else's account, no circumvention of security measures. Access through AI agents and through our documented interfaces is expressly permitted; what is prohibited is only automated access that loads the service abusively or evidently excessively. You are responsible for anything done through your access or through an agent you have authorised.

Connected third-party services

Bookheap relies on services we do not operate: Open Library (Internet Archive) for titles and covers, Amazon Web Services for delivery and accounts, and, if and once you set up such a connection yourself, Oura for your daily summaries.

Those providers supply their services solely on their own terms. To the extent permitted by the applicable law, those third-party providers disclaim all warranties, whether express, implied or statutory, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement, and they do not accept liability for indirect, consequential, special or punitive damages. We ourselves give no warranty for the availability, content or accuracy of those services.

Mandatory statutory claims available to you under German or European law, against us or against those providers, in particular for intent, gross negligence or injury to life, body or health, remain unaffected.

Connecting your Oura ring

A connection to Oura comes about only if you set it up expressly, and rests solely on your consent. You can withdraw it at any time in Settings and separately at Oura; withdrawal takes effect immediately, and after a withdrawal or a deletion request we remove all data obtained from Oura within 72 hours. The details of the processing are in the privacy policy.

Data obtained from Oura is not fed to any AI model, neither as input nor for training, and it does not appear in Bookheap's agent interface or in the response of any Bookheap tool. We retrieve only the values the suggestion needs, even where you have granted wider permissions.

Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For ordinary negligence we are liable only for breach of a material obligation, meaning one whose fulfilment makes proper use of Bookheap possible in the first place and on whose observance you may reasonably rely, and then only up to the damage that was foreseeable at the time the contract was concluded and is typical for this kind of agreement. Otherwise our liability for ordinary negligence is excluded. Liability under the first paragraph, and liability where a guarantee has been given or a defect fraudulently concealed, remains unaffected. These provisions also apply in favour of our legal representatives and agents.

Ending it

You can stop at any time and without giving reasons by deleting the app. You remove your account and library in Settings; that deletion is final and cannot be undone.

If you seriously breach these terms, we may suspend your account. Where the breach can be cured, we will ask you to do so within a set period beforehand, unless that is unreasonable given the severity of the breach or legal requirements. We will tell you about a suspension in text form, stating the reason, and you can object to it. Deletion of the account follows only if the breach continues or is repeated after the suspension, and at the earliest 30 days after that notice, so that you can obtain a copy of your library beforehand; a message to the address in the legal notice is enough. Either side's right to terminate for good cause remains unaffected.

Changes to these terms

We may change these terms with effect for the future where there is a valid reason. A valid reason is only: a change in the law or in the case law of the highest courts, an official or judicial order, a change to the terms of a third-party provider we use, the introduction of new features or the discontinuation of existing ones, or the closing of a gap in these terms. The change may not shift the balance of performance and consideration to your disadvantage and may not create additional cost for you.

If you have an account, we will tell you about the change in text form by email at least 30 days before it takes effect, together with your right to terminate the account without notice before then. Consent is never presumed from silence. If you object, use of the account ends when the change takes effect; you can request a copy of your library beforehand. Without an account, the version in force is the one published on this page with its date. A change to these terms never broadens how we use data obtained from Oura; that always takes a fresh consent.

Governing law and contact

German law applies. If you are a consumer habitually resident in another country, the mandatory consumer-protection rules of that country remain unaffected.
